These Terms of Use ("Terms") govern your access to and use of zezulafoundation.org and any services provided by The Zezula Foundation, Inc. ("the Foundation"). By using this site, you agree to these Terms. If you do not agree, please do not use the site.
1. Use of the site
You may use this site to learn about the Foundation, donate, subscribe to communications, and contact the Foundation. You agree not to:
- use the site for any unlawful purpose;
- attempt to gain unauthorized access to any portion of the site or related systems;
- interfere with the operation of the site or burden it with automated requests;
- misrepresent your identity, donor designation, or affiliation;
- submit content that is false, defamatory, abusive, or violates third-party rights.
2. Donations
Tax-deductibility. The Foundation is a §501(c)(3) public charity under Internal Revenue Code §170(b)(1)(A)(vi). EIN 93-4842735. Donations are tax-deductible to the fullest extent allowed by law. The Foundation will provide you with a contemporaneous written acknowledgement of your gift as required by IRS regulations.
Designations. You may designate your gift to one of our three program areas (Housing, Education, Cancer Research) or leave it undesignated for the board to allocate. Designated gifts will be used for the designated program. The Foundation reserves the right to redirect a designated gift if the underlying program is discontinued or if directed use becomes impossible; in such cases the Foundation will notify the donor and use the gift in a manner consistent with the original designation.
Refunds. Donations are generally final. If you believe an error has occurred, contact hello@zezulafoundation.org within 30 days. The Foundation will issue refunds for clearly documented errors (duplicate charges, unauthorized transactions, incorrect amounts).
Recurring gifts. If you set up a recurring gift, you authorize the Foundation's payment processor to charge the designated payment method on the recurring schedule until you cancel. You may cancel a recurring gift at any time by following the link in any donation receipt or by writing to us.
Quid pro quo. The Foundation does not provide any goods or services in exchange for donations unless specifically stated in writing.
3. Intellectual property
All content on this site — including text, graphics, logos, images, and the foundation's wordmark — is the property of The Zezula Foundation or its licensors and is protected by U.S. and international copyright and trademark law. You may view and download content for personal, non-commercial use only. You may not reproduce, distribute, modify, or use the foundation's name or wordmark without express written permission, except as permitted by fair use.
4. Third-party links
This site may link to third-party websites. The Foundation does not endorse, and is not responsible for, the content, privacy practices, or accuracy of any third-party site.
5. Disclaimers
The site is provided "as is" and "as available," without warranties of any kind, express or implied. The Foundation does not warrant that the site will be uninterrupted, error-free, or secure. Information on this site is provided for general informational purposes and is not financial, legal, tax, or investment advice. Consult your own advisors for guidance on charitable giving and tax matters.
6. Limitation of liability
To the maximum extent permitted by law, neither the Foundation nor its directors, officers, employees, or agents shall be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site, including but not limited to loss of data, loss of revenue, or business interruption.
7. Indemnification
You agree to indemnify and hold harmless the Foundation from any claim or demand arising from your violation of these Terms or your unlawful use of the site.
8. Governing law
These Terms are governed by the laws of the State of New York (the Foundation's state of incorporation), without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in New York County, New York.
9. Changes
The Foundation may revise these Terms from time to time. The "Last updated" date above will reflect the most recent change. Continued use of the site after a change constitutes acceptance of the revised Terms.
